These Terms of Service ("Terms") govern your use of justbriliante.com and the services we provide through it. By using the site or submitting an inquiry, you agree to these Terms.
1. About us
Briliante is a professional buyer of diamonds and fine jewelry. We operate from offices in New York, Miami, London, Antwerp, Paris, Milan, Madrid, Lisbon, Los Angeles, Dubai, Bangkok and Hong Kong. You can reach us any time at info@justbriliante.com or on WhatsApp.
2. Using our website
You may browse the site, request a valuation, or submit items for our consideration. You must not:
- Use the site for any unlawful purpose.
- Attempt to access areas not intended for public use (admin, partner portal).
- Submit knowingly false information.
- Upload viruses, malware, or content you do not have the right to share.
- Scrape, copy, or redistribute site content without written permission.
3. Valuations and offers
Preliminary valuations
Any estimate we provide based on photos, descriptions, or certificates is preliminary and non-binding. It reflects our best assessment given the information available and current market conditions. The actual offer may be higher or lower after in-person inspection.
Final offers
A binding offer is made only in writing after we have physically inspected the piece. You are free to accept, negotiate, or decline. Declined pieces are returned to you at our expense via insured shipping, with no obligation on your part.
Offer validity
Written offers are valid for 7 days unless stated otherwise. Precious metal and diamond prices move; an expired offer may be repriced.
4. Your representations when selling to us
By sending us an item, you represent and warrant that:
- You are the rightful owner, or are legally authorised to sell on the owner's behalf.
- The item is free of liens, claims, and encumbrances.
- You are at least 18 years old and of sound mind.
- The information you've given us (certification, history, condition) is accurate to the best of your knowledge.
- The item is not stolen, counterfeit, synthetic (unless disclosed), or otherwise misrepresented.
If any of these turn out to be untrue, we may cancel the transaction and return the item, and you may be liable for costs we incur.
5. Shipping and insurance
We arrange fully insured collection and return shipping through partners including Brinks and Malca-Amit, underwritten by Lloyd's of London. Items are insured from the moment they are handed to the carrier until they reach our secure facility, or back to you.
You are responsible for packaging items securely and declaring the contents accurately to the carrier we appoint. Shipping outside our standard network is at your own cost and risk unless otherwise agreed in writing.
6. Payment
Once an offer is accepted and the item authenticated, payment is made by bank transfer to an account in your name. Payment timelines vary by jurisdiction, typically 1–5 business days after acceptance. We do not pay in cash, cryptocurrency, or to third-party accounts.
7. Know Your Customer (KYC) and AML
We are required by law in several jurisdictions to verify the identity of sellers and the source of items. You agree to provide reasonable documentation when requested. We may decline a transaction where verification cannot be completed.
8. Cancellation and right to withdraw
You may withdraw your item at any time before you accept a written offer. Once an offer is accepted in writing, the transaction is binding, subject to successful authentication and KYC.
9. Intellectual property
The site, brand, content, photography, logos, and code are owned by Briliante or licensed to us. You may not copy, modify, or distribute them without permission. Photos you submit remain yours, but you grant us a limited licence to use them for valuation and record-keeping purposes.
10. Disclaimers
The site and our non-transactional content are provided "as is". While we aim for accuracy, market data, pricing estimates, and educational material are for general information only and not a substitute for professional appraisal. We do not guarantee uninterrupted availability of the site.
11. Limitation of liability
To the maximum extent permitted by law, our liability arising out of or in connection with these Terms or the services is limited to the value of the transaction in question. We are not liable for indirect, consequential, or incidental losses. Nothing in these Terms limits liability for fraud, gross negligence, or anything else that cannot be excluded by law.
12. Governing law and disputes
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Disputes shall first be raised with us directly at info@justbriliante.com. If unresolved, the exclusive forum is the courts of New York County, New York, unless mandatory local consumer law requires otherwise.
13. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the current version. Continued use of the site after changes constitutes acceptance.
14. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
